Terms of Service
Please read these Terms of Service ("Terms") carefully before using the Dishcover mobile application and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Who Can Use Dishcover
You must be at least 13 years old to use Dishcover. By using the Service, you represent that you are 13 or older. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Your Account
To use most features of Dishcover, you must create an account. You are responsible for:
- Providing accurate account information
- Keeping your password secure and confidential
- All activity that occurs under your account
If you believe your account has been compromised, contact us immediately at contactdishcover@gmail.com. We reserve the right to terminate accounts that violate these Terms.
3. The Service
Dishcover is a food discovery and meal planning application that allows you to:
- Browse a personalized feed of food content
- Save recipes and dishes to your personal collection
- Import food content from third-party platforms
- Plan weekly meals using a calendar interface
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where possible.
4. Subscriptions and Billing
Dishcover offers a free tier and a premium subscription ("Dishcover Premium").
Free tier includes:
- Up to 10 video saves per day
- 1 TikTok import per day
- Access to the discovery feed and meal calendar
Dishcover Premium includes:
- Unlimited video saves
- Unlimited TikTok imports
- Additional features as added over time
Premium subscriptions are billed on a monthly or annual basis as displayed at purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. To cancel, use the account management settings in the App Store (iOS) or Google Play (Android). We do not process cancellations directly.
Refunds are handled according to the App Store or Google Play refund policies. We do not issue refunds outside those policies.
5. Content and Intellectual Property
Your content
Any content you create within the app (meal plans, notes, lists) remains yours. You grant us a limited license to store and process your content solely to provide the Service.
Third-party content
Dishcover allows you to save links and references to food content from third-party platforms. We do not claim ownership of third-party content. You are responsible for ensuring your use of third-party content complies with the terms and copyright of the original platform.
Our content
The Dishcover name, logo, app design, and original content are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without our written permission.
6. Acceptable Use
You agree not to:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the Service or its infrastructure
- Use the Service to distribute spam, malware, or harmful content
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Impersonate another person or misrepresent your affiliation with any entity
- Use automated tools (bots, scrapers) to access the Service without our written consent
We reserve the right to suspend or terminate your account for violations of these rules without prior notice.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the fullest extent permitted by law, Dishcover and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service
- Unauthorized access to or use of our servers or your personal information
- Any conduct or content of third parties on the Service
Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or $10 if you have not paid us anything).
9. Indemnification
You agree to indemnify and hold harmless Dishcover and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
